1. Agreement to Terms

By using the Kidney Buddy web application, available at kidneybuddy.app (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms are a legal agreement between you and Kidney Buddy ("we", "us", or "our"), the independent developer of Kidney Buddy.

Kidney Buddy is not a medical device and does not provide medical advice. The Service is intended for informational, educational, and tracking purposes only. The information and tools provided by the Service, including AI-generated diet plans and health tips, are not a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or tracked on the Service. If you think you may have a medical emergency, call your doctor or emergency services immediately.

We do not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned on the Service. Reliance on any information provided by Kidney Buddy is solely at your own risk.

3. User Accounts and Responsibilities

To use the Service, you must be 18 years of age or older. You are responsible for safeguarding your account and for any activities or actions under your account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for all data you enter into the Service, including the accuracy of your health information, lab results, and medications. We are not responsible for any errors or inaccuracies in the data you provide.

4. Use of the Service

You agree not to misuse the Service. For example, you must not:

  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law.

The Service integrates with third-party services, including Google, OpenAI, and WhatsApp. Your use of these third-party services is subject to their respective terms and conditions and privacy policies. We are not responsible for the practices of any third-party services.

We own all right, title, and interest in and to the Service and its content, including all associated intellectual property rights. You may not copy, modify, distribute, sell, or lease any part of our Service or its software.

7. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. You can terminate your account at any time by contacting us at support@kidneybuddy.com.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall developer be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service; and
  • Unauthorized access, use or alteration of your transmissions or content.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of EU, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
